Terms and Conditions for Kings Way Home Services


These terms and conditions ("Agreement") outline the terms of service between Kings Way Home Services and the customer in relation to TV mounting, handyman, and individually requested task by the customer. By engaging the services of Kings Way Home Services, the Customer agrees to the following terms and conditions:

  1. Scope of Work: a) The Service Provider will perform TV mounting and handyman services as agreed upon with the Customer. b) The Customer will provide all necessary information regarding the job requirements, including the location, type of TV/appliance, desired positioning, and any specific requests. Additional task request will be calculated and charged into the original bill before the request.

  2. Service Limitations: a) The Service Provider will perform services within the scope of their expertise and capabilities. b) The Service Provider reserves the right to decline any services that are deemed unsafe, illegal, or outside the expertise of the Service Provider.

  3. Service Charges: a) The Customer agrees to pay the agreed-upon service charges as outlined by the Service Provider. b) Additional charges may apply for any extra services, materials, or unforeseen circumstances encountered during the job. These additional charges will be communicated to the Customer for approval before any additional work is carried out. A travel charge of $50 will be included for appointments located further than 20 miles from the original dispatch location in 44102. Projects beyond 20 miles of the dispatch zip code must meet a minimum of a $225 project cost requirements. All clients located in central "downtown" areas are responsible for providing free parking recommendations that will allow technicians close access to their residents. If unable, then technician will park in the nearest parking garage and a parking fee of $15 will be included into the project bill. If a technician is responsible for clearing the work area of large furniture and valuables a $25 charge will be included on the project balance due to insurance liability.

  4. Customer's Responsibilities: a) The Customer must provide accurate and complete information regarding the job requirements, including any potential risks, limitations, or obstacles. b) The Customer is responsible for obtaining any necessary permissions, permits, or authorizations required for the service. c) The Customer must ensure the availability of the necessary tools, equipment, and access to the premises for the Service Provider to perform the service. d) The Customer must ensure the work area is clear of valuables, furniture, and clutter prior to a requested task being started. e) The Customer must ensure all pets, small children (13 and under) , elderly persons, disabled persons, mentally challenged person are contained in a safe area at least 10 feet from a technician at work. Kings Way Home Services is not responsible for any damages or injuries that occur from violating this agreement.

  5. Liability and Warranty: a) The Service Provider will exercise reasonable care and skill in performing the service. However, the Service Provider is not liable for any damage, loss, or injury resulting from the service unless caused by the Service Provider's negligence. b) The Service Provider is not responsible for any pre-existing defects or damage to the TV, appliances, or property, unless caused directly by the Service Provider during the service. c) The Service Provider will not be held liable for any unforeseen circumstances, delays, or disruptions beyond their control, including but not limited to acts of nature, power outages, or third-party negligence. d) In regards to TV MOUNTING, all installs have a 100 day warranty and insurance in place to cover any damages that may occur from the tv falling from is installation location due to negligence by the Service Provider. Remedy will be issued after an investigation once a claim is filed which can take up to 100 days.

  6. Indemnification: a) The Customer agrees to indemnify and hold the Service Provider harmless against any claims, damages, losses, or expenses arising out of or in connection with the service, except where caused directly by the Service Provider's negligence.

  7. Cancellation and Rescheduling: a) The Customer must provide reasonable notice (within 48 hours of scheduled start) to the Service Provider for any cancellation or rescheduling of services. Failure to do so may result in a cancellation fee and lost of deposit. b) The Service Provider reserves the right to cancel or reschedule services due to unforeseen circumstances or emergencies. In such cases, reasonable efforts will be made to notify the Customer in advance.

  8. Confidentiality: a) The Service Provider agrees to keep all customer information confidential and not disclose it to third parties, except as required by law or with the express consent of the Customer.

  9. Governing Law and Jurisdiction: a) This Agreement shall be governed by and interpreted in accordance with the laws of The State of Ohio. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of The State of Ohio.

  10. Entire Agreement: a) This Agreement constitutes the entire agreement between the Service Provider and the Customer, superseding any prior agreements or understandings, whether written or verbal.

By engaging the services of Kings Way Home Services, the Customer acknowledges that they have read, understood, and agreed to these terms and conditions.
